Acceptance of terms

By using the River's Garden Co. website, booking a U-Pick session, or contacting us to place an email order for cut flowers, you agree to these Terms of Use. If you do not agree, please do not use the website or place an order.

How ordering works

Orders come through two paths: the online U-Pick booking system linked from this website, and direct email or phone for pre-cut arrangements, event flowers, and larger custom orders. Email and phone orders are not confirmed automatically. Your order is confirmed only after we reply with:

  • Confirmation that the flowers you want are (or will be) in bloom for your date
  • The final total, including any delivery arrangement if applicable
  • Payment instructions (typically e-Transfer)

We reserve the right to decline any order, including where the requested varieties are not available in the season you asked for, where the volume exceeds our supply, or for any other reason. Declined orders incur no charge.

Seasonality and substitutions

Cut flowers are a seasonal product. Specific varieties, colours, and quantities available on any date depend on weather, growing conditions, and the timing of the season. If a variety you specifically requested is not available on your date, we will contact you to offer a substitution of equal or greater value from what is in bloom. If you would rather not accept a substitution, you can cancel that portion of your order and receive a refund. See our Disclaimer for more.

Payment

Payment is by Interac e-Transfer or another method agreed at confirmation. Payment is due by the deadline in the confirmation (typically before cutting or arranging begins). Orders for which payment has not been received by the deadline may be released to another customer or cancelled.

U-Pick bookings

U-Pick sessions are booked through the third-party booking system linked from this site. That booking system's own terms of service also apply. U-Pick sessions are weather-dependent; if we need to cancel or reschedule, we will notify you as early as possible and either reschedule or refund your booking.

Cancellations and changes

Cancellation windows depend on whether the flowers have already been cut. As a general guide: cancellations more than 48 hours before pickup for uncut orders are refundable in full. Once flowers have been cut and arranged for you, cancellations are non-refundable because the product cannot be re-sold in the same condition. U-Pick session cancellations follow the booking system's cancellation window.

Pickup, delivery, and care

Most orders are picked up in Howden, Manitoba, at a time arranged in the confirmation. Delivery may be offered for larger orders, subject to distance. Once your flowers are picked up or delivered and in your care, follow the care instructions provided so they last. Because flowers are perishable, we cannot accept returns or offer refunds for flowers that have wilted or discoloured due to storage or transport conditions after they left our care.

Use of the website

You may use this website only for lawful purposes: to learn about the farm, view varieties in bloom, and place orders or book U-Pick sessions. Automated scraping of the site for commercial purposes is prohibited without prior written consent.

Content and intellectual property

All content on this website (text, photography, illustrations, branding) is the property of River's Garden Company and is protected by Canadian and international copyright and trademark laws.

Third-party links and content

Links to Instagram, the booking system, and other third-party services are provided for convenience. Those services operate independently. Their use is governed by their own terms.

Disclaimer of warranties and limitation of liability

Content on this website is provided on an "as is" and "as available" basis. See our Disclaimer for full detail. To the maximum extent permitted by law, River's Garden Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your access to or use of this website.

Governing law

These Terms of Use are governed by the laws of the Province of Manitoba and the laws of Canada applicable therein. Any dispute is subject to the exclusive jurisdiction of the courts of Manitoba.
